1. Eligibility
You must be legally able to enter into these Terms. If you are below the age of legal majority where you live, your parent or legal guardian must review and accept these Terms and supervise your use. The App is not directed to children under 13. You must meet any higher minimum age required by applicable law.
2. What the App provides
The App provides remote control, TV application launching, and photo and video casting for compatible Samsung TVs. Available functions depend on your TV model, firmware, iOS version, network, and supported media formats.
Your device and TV generally need to be on the same local network. You may need to enable local network access and approve pairing on the TV. Some commands, power functions, media formats, or applications may not work on every TV. The App does not guarantee universal compatibility, continuous connectivity, or access to third-party content.
The App is an independent product of DLD Innovation Company Limited. It is not affiliated with, endorsed by, or sponsored by Samsung Electronics. Samsung names and marks belong to their respective owners. References to Samsung identify compatibility only.
3. License and Apple terms
You may use the App for lawful purposes on devices you own or control, subject to these Terms and applicable App Store rules. Ownership of the App and its intellectual property remains with us or our licensors. Third-party and open-source components remain subject to their applicable licenses.
For copies obtained through Apple’s App Store, Apple’s Standard Licensed Application End User License Agreement governs the software license unless a separate custom EULA is expressly supplied through the App Store. These Terms supplement that license with terms for the App’s functionality and services. If a software-license provision conflicts, the applicable EULA controls. Apple is not the provider of the App’s services; contact us for App support.
4. Acceptable use
You agree to:
- Control only TVs and networks you own or are authorized to use.
- Cast only content you own or have permission to display, and respect the privacy of people shown in it.
- Follow applicable laws and the terms of TV manufacturers and third-party services.
- Keep your device and network reasonably secure and protect pairing credentials.
You must not use the App to gain unauthorized access, interfere with other users or devices, distribute unlawful or infringing content, bypass access restrictions or digital rights management, or disrupt the App or its advertising systems. You must not copy, resell, modify, or reverse-engineer the App except as permitted by applicable law or an applicable component license.
5. Your media and third-party content
You retain your rights in the photos, videos, and other content you use with the App. You authorize only the copying, preparation, transmission, and display necessary to carry out your requested casting actions. These Terms do not give us ownership of your media or permission to use it for advertising.
You are responsible for selecting the intended TV and considering who can see or hear the content you cast. Casting may use unencrypted local-network protocols. Use a trusted network.
Launching a TV application does not give you a subscription, content license, or other entitlement to that service. Third-party services may require their own accounts, payments, and agreements. We do not control their availability, content, or policies.
6. Advertising and charges
The current App includes advertising. Ad formats, availability, and frequency may change. Advertising does not constitute our endorsement of an advertiser or its products. Transactions with advertisers are between you and the relevant third party.
The current version does not offer in-app purchases or subscriptions. If paid features are introduced, the price and applicable payment, renewal, cancellation, and refund terms will be disclosed before you purchase. Your internet, mobile data, electricity, device, and third-party subscription charges remain your responsibility.
7. Privacy
Our Privacy Policy explains the handling of local TV information, selected media, advertising data, configuration services, and support communications. Review it through the App’s Settings. Accepting these Terms does not replace any separate consent required for personal data processing or tracking.
8. Updates and availability
We may update, modify, or discontinue features for compatibility, security, operational, or legal reasons. TV firmware and third-party service changes may also affect the App. We will provide notice where required by law and honor any rights that cannot lawfully be excluded. You may need to install updates to continue using certain features.
9. Warranties and liability
To the extent permitted by applicable law, the App is provided on an “as is” and “as available” basis. We do not promise that it will be uninterrupted, error-free, or compatible with every device or media file. Statutory warranties and consumer guarantees that cannot be excluded remain in effect.
To the extent permitted by applicable law, we are not responsible for indirect or consequential losses arising from use of the App, including lost profits or business opportunities. This exclusion does not apply where prohibited by law, and nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited. Your mandatory consumer remedies remain available.
10. Ending use
You may stop using and uninstall the App at any time. You may also revoke the App’s authorization through your TV’s connection settings. Uninstalling the App may not remove pairing records on the TV or tokens stored in iOS Keychain.
We may terminate your permission to use the App for a material breach of these Terms, subject to any notice and opportunity to remedy required by law. On termination, you must stop using the App. Provisions that by their nature need to survive termination, including ownership, liability, and dispute provisions, continue to apply.
11. Changes to these Terms
We may revise these Terms and will publish the revised version with an updated effective date. Material changes will be notified where required, and we will seek acceptance where the law requires it. If you do not accept the revised Terms, stop using the App. Changes do not remove rights accrued before they take effect.
12. Applicable law and disputes
These Terms are subject to applicable law, including any mandatory consumer protections in your country of residence. Nothing in these Terms removes your right to bring a claim before a court or authority available to you under applicable law. If a dispute arises, you may contact us first to seek a resolution, but doing so is not a condition for exercising your legal rights.
If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a provision does not waive our right to enforce it later.
